Not every item applies to every sale. Gas and electric fence certificates only matter if those installations exist, and the beetle certificate usually comes from a clause in the agreement rather than from legislation. The unit owner

The seller of a unit arranges certificates for what is inside the unit: its wiring, DB board and sockets, its water installation and any gas appliance. A balcony light or sun-room socket that you added counts as part of your installation.

The body corporate

Common property, such as passage lighting, gate motors, the main board, pumps and any electric fence, is normally the body corporate’s responsibility. A seller who needs copies of those certificates for the transfer attorneys should ask the managing agent early. Trustees are wise to keep a current set on file and refresh it after any work.

Coastal wear

Units near the water often see salt damage to external fittings, meter-room boards and balcony lights. A pre-inspection lets the owner and trustees see what needs attention before a buyer’s attorney does.

What Fails in Milnerton Homes and How It Is Put Right

A failed inspection is a list of faults with standard remedies. These are the items that most often hold up transfers on homes of any age near the coast.

Electrical

  • No working earth leakage protection. Older boards may have none, or a unit that no longer trips. The fix is a tested earth leakage device or a new board.
  • Corroded or overheated board. Salt air can corrode terminals inside a DB board. A damaged board is usually replaced, not patched.
  • Do-it-yourself additions. Extension wiring, outside sockets and lights added without certification must be made compliant or removed.
  • Unprotected outbuilding supply. The cable, protection or earthing is corrected.
  • Missing labelling. Circuits must be labelled, which can often be fixed on the spot.

Water

  • Dripping taps and leaking fittings are repaired or replaced.
  • A water meter that keeps registering when every tap is closed points to a hidden leak that needs tracing.
  • Stormwater connected to the sewer, or cross-connections between drinking water and other supplies, are re-routed.

Four Dates to Watch During a Milnerton Transfer

Most delays come from certificates that are booked late or that expire during the sale. Keep these four checkpoints in mind.

  1. Mandate date. Under the Property Practitioners Act, the seller or lessor completes a mandatory disclosure form before the agent takes the mandate. Raise the certificates at this stage, not after an offer.
  2. Offer date. Read the compliance clauses. They say which certificates are needed and who arranges them.
  3. Repair and re-test date. Faults are fixed, the installation is tested again and the certificate is issued.
  4. Lodgement date. The electrical certificate must not be older than two years on the day of the change of ownership, under regulation 7(5). If a sale drags on, check the date again before the attorneys lodge.

Beetle, Gas and Electric Fence Certificates in a Coastal Suburb

Three certificates work differently from the electrical COC, and they cause most of the confusion.

Beetle

A beetle certificate is not required by legislation. It comes from a clause in the sale agreement and is customary in coastal parts of the Western Cape, where timber-destroying insects are a genuine risk. The inspector must be registered with the South African Pest Control Association. See the beetle certificate page.

Gas

The gas certificate of conformity is required under the Pressure Equipment Regulations and must come from an authorised person registered with LPGAS. It covers fixed pipework, fixed appliances and cylinder positions, and not a portable braai. See gas compliance certificates.

Electric fence

Electric fences fall under the Electrical Machinery Regulations, 2011, which apply to systems installed or altered after 1 October 2012. Warning signs form part of the requirement. Landlords, Tenants and Business Owners in Milnerton

Rental homes and business units need valid certificates just as sales do, though the trigger differs. Regulation 7 of the Electrical Installation Regulations requires every user or lessor to hold a valid electrical certificate of compliance. For a rented house or flat, that normally means the owner. A lease can pass responsibility to the tenant, but a tenant should ask to see a current certificate before agreeing.

For business premises, the unit’s electrical certificate sits alongside the lease. Tenants of warehouse and office units should record who owns the main board, who owns tenant sub-boards and who must certify any alteration. People often assume the seller always pays. The usual position is that the seller arranges the certificates, but the legal duty sits with the user or lessor of the installation and the offer to purchase decides who bears the cost.

  • Seller: normally arranges and pays, unless the agreement says otherwise.
  • Buyer: should ask for certificates before signing, check they match what is installed and note their dates against the transfer date.
  • Agent: raises certificates at mandate stage and books inspections together so the seller deals with one appointment list.
  • Conveyancer: collects originals, checks dates against the expected registration and submits the water certificate to the City.

If a buyer agrees to take over repairs, get that in writing in the agreement. A verbal promise does not help when the bank’s attorneys ask for the certificate.

Preparing a Milnerton Property for Inspection

Preparation saves a second visit. Walk through the property with this list a few days before the inspector arrives.

  • Unlock every area that must be certified, including garages, outbuildings, roof access and meter boxes.
  • Tell the inspector about every installation, such as a granny flat, borehole pump, pool equipment, inverter or gas hob.
  • Plan for a short power cut, because testing needs the supply off at the board.
  • Replace cracked faceplates and failed bulbs, and press the earth leakage test button.
  • Near the lagoon or beach, wipe away visible salt crust on outdoor fittings and look for rust on the board cover.
  • Gather old certificates, appliance manuals and any solar or inverter paperwork.

Telling a Valid Certificate From a Worthless One

The Department of Employment and Labour has warned the public about people posing as registered electrical contractors and issuing certificates for unsafe installations. A bad certificate can collapse a transfer, leave you with a dangerous house and cause a dispute with a bank or insurer.

A proper electrical certificate shows

  • The registered person’s name, signature and registration details.
  • A unique certificate number and the date of issue.
  • The address and a description of the installation covered.
  • An attached test report with actual results.

Red flags

  • A certificate offered without anyone visiting the property.
  • A price far below every other quote, or a promise of same-day sign-off with no testing.
  • Blank or unreadable test sections.
  • An inspector who cannot show registration when asked.

Compliance Certificates Milnerton: More Questions Answered

Most sales ask for an electrical certificate of compliance and a City of Cape Town water installation certificate. Gas and electric fence certificates apply only if you have those installations, and a beetle certificate is common in the Western Cape because it is a usual contract clause. Your offer to purchase lists exactly what is required.

Your own certificates cover what is inside your unit. Transfer attorneys may also ask for copies of the body corporate’s certificates for common property, such as gate motors, passage lighting and any fence. Ask the managing agent for them early, because the scheme, not you, controls those documents.

Regulation 7(5) of the Electrical Installation Regulations says a change of ownership may not take place if the certificate is older than two years. The certificate has no general expiry otherwise. If your sale takes months or you altered the wiring afterwards, check the date and arrange a new one before lodgement.

The offer to purchase decides, because the parties can agree terms beyond the legal minimum. A buyer’s bond provider or insurer may also have its own requirements. If your certificate is current but the contract asks for something different, take the question to your conveyancer in writing before you book anything.

No. A certificate records the condition of the fixed installation on the day it was tested, supported by a test report. It does not certify that appliances work, and it does not predict future condition. That is why buyers should read the report and sellers should keep the paperwork for any later additions.

Additions and alterations need a certificate for the new work, under regulation 7(4). That includes extra circuits, garden lighting and a new board. Having it issued at the time costs less trouble than trying to certify unknown work at the point of sale, when time is short.

The regulations require the user or lessor to hold a valid certificate for the installation, so it is safest to hold a current one. A written undertaking can move the duty to the tenant, but the paperwork must exist. Arrange access with notice, as testing needs the supply switched off at the board for a short time.

You receive a report listing each fault and an itemised quotation. You can accept the repairs, negotiate the scope or get a second opinion. Once the work is done, the installation is tested again and the certificate issued. Nothing is certified while a fault remains, so building in time for repairs avoids last-minute pressure.
