These Terms and Conditions apply to all quotations and work carried out by Thermoelectrics (Pty) Ltd, trading as Thermo Group. COC means Certificate of Compliance.
- Company: Thermoelectrics (Pty) Ltd, trading as Thermo Group ("the Company"). These terms apply to all electrical, solar, plumbing and compliance work.
- Validity and pricing: Quote valid for 14 days, subject to stock availability. Prices may be adjusted if supplier prices or exchange rates change materially before equipment is ordered. All prices are VAT inclusive.
- Scope: Only the work and materials listed are included. Work outside this scope is a variation, charged separately, and must be approved by the Client in writing (email or WhatsApp) before it starts.
- Exclusions: Building work, plastering, tiling and painting are excluded; making good is limited to rough filling. Disposal of old equipment is done without charge; larger equipment may require a charge for rigging and transport. Client-supplied materials are not warranted.
- Payment: A 70% deposit is required on all jobs before materials are ordered or work starts; the balance is due on completion. Interest is charged on overdue amounts at 2% per month, being the maximum rate permitted under the National Credit Act 34 of 2005 (or such lower maximum rate as may apply from time to time).
- Non-payment: If payment for work done is not received when due, the Company will hand the account over for collection and/or take legal action to recover the full amount owed. The Client is liable for all legal and collection costs on the attorney-and-client scale.
- Certificates: COCs, supplementary COCs and plumbing certificates are issued only once payment has been received in full.
- COC inspections: Inspection fees are payable upfront and are non-refundable. A report and repair quote will only be provided once the inspection fee has been paid in full. The Company only issues COCs on work carried out by the Company and does not issue a COC on any other contractor's work. If the Client has the repairs done by another contractor, the Company will not return to sign off those repairs; that contractor must be licensed and registered to issue the COC for their work.
- Solar and inverters: A connected inverter requires a supplementary COC. A valid, up-to-date original COC for the property must be provided before the Company can issue a supplementary COC for any backup or solar system. If the original installer cannot issue it, the Company will inspect at the inspection fee; faults are quoted separately, and certificates are issued once the Company has completed the repairs. Registration of the system with the City of Cape Town is the owner's responsibility unless quoted. Generation, savings and backup-time figures are estimates, not guarantees. The Company is not responsible for the structural condition of the roof or existing roof leaks. The Client provides Wi-Fi for system monitoring.
- Earth leakage: Tripping may occur once an earth leakage is replaced or earthing is repaired; please notify the Company. Geysers must be on earth leakage (SANS 10142-1). Faulty geyser elements and older, sensitive earth leakage units are replaced at the Client's cost; a quote will be provided.
- Plumbing: Existing pipework and fittings that are aged or corroded and not replaced are not guaranteed against leaks or failure. Plumbing COC repair quotes cover compliance-related items only; cosmetic changes or upgrades will not be quoted for.
- Standards: Work is done to SANS 10142-1, SANS 10252/10254 and City of Cape Town by-laws. The quote is based on the visible condition of the installation.
- Access: The Client provides safe, clear access to all work areas, including the roof and distribution board, and keeps children and pets away. Access delays may incur extra labour charges. The Client arranges for equipment affected by power or water shutdowns.
- Hidden conditions: The Company is not responsible for latent defects, concealed wiring, hidden plumbing, underground services, roof defects, asbestos or pre-existing non-compliance. These will be quoted separately. If site conditions on the day differ from those seen at quoting, any extra work will be quoted as a variation.
- Liability: Liability is limited to the value of the quote. The Company is not liable for consequential loss (e.g. spoiled food, lost income or data). This does not limit liability for gross negligence or the Client's rights under the Consumer Protection Act.
- Delays: The Company is not liable for delays caused by weather, supplier shortages, municipal or Eskom outages, Client delays, or circumstances beyond its reasonable control.
- Ownership and risk: All materials remain the Company's property until paid in full. The Company may remove unpaid equipment that can be removed without damage (e.g. inverters, batteries, panels). Once equipment is delivered to site, the Client is responsible for its loss, theft or damage. The Client should add solar and battery systems to their home or building insurance.
- Warranty: Workmanship is warranted for 12 months from completion; work after this is charged. Equipment carries the manufacturer's warranty only, subject to the manufacturer's inspection; call-outs for claims may be charged. Excludes misuse, accidental damage, lightning, power surges, flooding, vermin, corrosion, lack of maintenance and alterations by others. Warranties apply only once the account is paid in full. Work is complete on handover, and any snags must be reported to the Company in writing within 7 days.
- Cancellation: If accepted work is cancelled after materials are ordered or work has started, the Client is liable for materials, labour completed, restocking fees and reasonable costs. The deposit is applied to these and any balance refunded.
- Photos and POPIA: The Company may photograph completed work for marketing, without identifying the Client or address, unless the Client objects in writing. Personal information is used only for the Works and accounts.
- General: If the Client is unhappy with any aspect of the work, please contact the Company in writing first. The Company commits to responding within 2 working days and working with the Client to resolve it. The Client consents to the jurisdiction of the Magistrate's Court, Cape Town. If any clause is unenforceable, the rest remain in force.
- Acceptance: By signing a quotation, accepting it in writing or paying a deposit, the Client accepts these Terms and Conditions, including the clauses limiting the Company's liability.
