Estates, Sectional Title and Freehold: Who Arranges What

The Helderberg has many gated estates, including Erinvale, Sitari, Somerset Lakes, the Croydon estates and a retirement estate with its own golf course. Ownership structure decides who is responsible for which certificate.

  • Freehold houses. The owner holds the certificates for the whole property, including outbuildings, the gate motor and any fence.
  • Houses in an estate. The individual owner is normally responsible for the house, while the homeowners’ association looks after common services such as boundary fencing, security lighting and entrance gates. Ask the managing agent which items the association certifies and which are yours.
  • Sectional title units. The unit owner provides certificates for the unit. The body corporate usually carries responsibility for common property such as shared boards, gate motors and electric fences.

Estate rules also affect access. Many estates need advance notice before an inspector or plumber can enter, with names and vehicle details. Arrange access when you book so the inspection is not delayed at the gate.

The Transfer Timeline and the Two-Year Electrical Rule

Most transfer delays happen because certificates were booked late. A typical sequence looks like this.

  1. Before listing. Book inspections while you are still choosing an agent, so any faults are known and can be fixed before a buyer is involved.
  2. Offer to purchase. The compliance clauses decide which certificates are needed, and who arranges and pays for them.
  3. Inspection and quotation. Faults are listed. If repairs are needed, you get a quotation and can accept it, negotiate or get a second opinion.
  4. Repairs and re-test. After the repairs, the installation is tested a second time before any certificate is issued.
  5. Handover. The conveyancing attorney collects the certificates. For the water certificate in Cape Town, the attorney submits it to the City.

The date that catches sellers out is the age of the electrical certificate. Regulation 7(5) of the Electrical Installation Regulations says a change of ownership may not go ahead if the certificate is more than two years old. A house that sits on the market for months may need its certificate checked again before transfer, and a house that has been altered since inspection may need new work certified.

Preparing the property before the inspector arrives

A little preparation avoids repeat visits. Give access to every board, the garage, outbuildings, the roof space, the geyser cupboard, gate motors and the meter box, because areas that are locked cannot be certified. Tell the inspector about everything that is installed, including a borehole pump, pool equipment, a granny flat and any solar or inverter system. If you live in an estate, tell security the inspector’s name and arrival window so the gate is not a delay.

Testing generally means switching the supply off at the board for a while, so warn tenants and switch off computers, and mention any medical equipment. Replace broken faceplates and dead bulbs, check that the test button on your earth leakage unit works, and find old certificates and solar documents. A short walk-through yourself will not replace an inspection, but it removes the easy failures.

What Fails Most Often in Helderberg Homes

Somerset West contains houses from several building eras, from older family homes that have been extended a few times to newer estate properties. The failure items tend to follow the age and history of the house.

Older houses and extended properties

  • Missing or faulty earth leakage protection on the main board.
  • An overcrowded or mixed-component board, or one with no labelling.
  • Do-it-yourself additions, garden lights and extension wiring that were never certified.
  • Missing bonding to metal pipework, or sockets with reversed polarity.

Newer estate homes

  • Later additions to a clean original installation, such as pool equipment, a home office or outdoor kitchen circuits.
  • Gate motors, intercoms and outdoor lighting wired without proper protection.
  • Solar or inverter installations added without the paperwork a buyer will expect.

Water, Gas, Electric Fence and Beetle Certificates in the Helderberg

Water installation certificate

In the City of Cape Town this is tied to the transfer. A plumber registered with the City checks items such as the hot water cylinder, the meter, taps and fittings, stormwater connections and cross-connections, and the conveyancing attorney submits the certificate. Gas

The gas certificate of conformity covers the fixed installation, meaning pipework, fixed appliances and cylinder positions. It does not cover portable items such as a gas braai. Many homes here have a gas hob or heater, so ask the plumber or gas installer. See gas compliance certificates.

Electric fence

Electric fences fall under the Electrical Machinery Regulations, and a certificate is issued by an appropriately registered person for systems installed or altered after 1 October 2012. Beetle

A beetle certificate is not required by legislation. It comes from a clause in the sale agreement and is customary in the Western Cape, where wood-destroying insects can affect roof timbers, door frames and floors. Inspectors must be licensed by the South African Pest Control Association. See beetle certificates.

Retirement Units, Holiday Homes and Investment Lets

Some Helderberg properties are not lived in full time, and that changes the paperwork.

  • Retirement estates. Units inside a retirement village usually fall under the estate’s rules. Ask the estate office what certificates they hold for common services and what they expect from owners at resale.
  • Holiday homes and beach bungalows. A house left empty for months should be inspected before it is sold or let, because unattended faults such as slow leaks and failing geysers are more common.
  • Landlords. Regulation 7(1) requires every user or lessor to hold a valid electrical certificate. A lease may shift some responsibility to the tenant, but a landlord is safest holding a current certificate before the tenant moves in.
  • Short-term lets. Where a guest house or holiday let changes occupants often, ask the insurer and the scheme about what they expect, since requirements vary.

If you are an agent, raise certificates at mandate stage, alongside the seller’s mandatory disclosure form. The disclosure form deals with known defects and does not replace compliance certificates, which are issued after an inspection.

Fake Certificates, Choosing an Inspector and Booking

The Department of Employment and Labour has warned the public about people who pose as registered electrical contractors and issue certificates for installations that were never properly tested. A proper electrical certificate shows the registered person’s name, signature and registration details, a unique number, the address and a description of the installation, the date, and an attached test report. Red flags include no site visit, a price far below every other quote, same-day certificates with no testing, and an inspector who cannot show registration.

Do I need a COC to sell my house in Somerset West?

Yes. An Electrical Certificate of Compliance is a legal requirement for every property sale in South Africa, and Plumbing, Gas and Electric Fence COCs are also required where those installations are present. We can issue all four for your Somerset West property transfer.
